Article 3 – Applicability

These general terms and conditions apply to all offers made by the entrepreneur and to all distance contracts and orders concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms will be made available to the consumer. If this is not reasonably possible, it will be indicated that the terms can be consulted at the entrepreneur’s premises and will be sent free of charge upon request.

If the contract is concluded electronically, the terms may be provided electronically so they can be stored on a durable medium.

If specific product or service conditions also apply, the consumer may always rely on the most favorable provision in case of conflict.

If any provision becomes invalid, the remaining provisions remain in force, and a replacement provision will be agreed upon.

Situations not covered will be assessed in the spirit of these terms. Any ambiguities shall also be interpreted in that spirit.

Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

The offer is non-binding, and the entrepreneur may modify it.

The offer includes a complete and accurate description of the products/services, detailed enough for proper evaluation. Images represent the products faithfully; obvious errors are not binding.

All images, specifications, and data are indicative and cannot lead to compensation or contract cancellation.

Each offer clearly states consumer rights and obligations, especially regarding:

the price excluding customs clearance costs and import VAT (these are the customer’s responsibility);

possible shipping costs;

how the agreement is concluded;

whether the right of withdrawal applies;

payment, delivery, and execution methods;

acceptance period or price guarantee;

communication costs;

whether the agreement is archived and how to access it;

how the consumer can check/correct provided data;

available contract languages;

applicable codes of conduct;

minimum contract duration for continuous transactions.

Optional: available sizes, colors, and materials.

Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and meets the conditions.

If accepted electronically, the entrepreneur will confirm receipt electronically. Until confirmation, the consumer may cancel.

The entrepreneur ensures secure electronic data transfer and safe payment measures.

The entrepreneur may verify the consumer’s ability to meet payment obligations and may refuse orders with justification.

The entrepreneur will provide the consumer with written or storable information, including:

complaint address;

withdrawal conditions;

warranty/service information;

details from Article 4;

termination requirements for long-term contracts.

Each agreement is subject to product availability.

Article 6 – Right of Withdrawal

The consumer may cancel a product purchase within 30 days without giving reasons. The period begins the day after receiving the product.

During this period, the consumer must handle the product carefully and only use it to evaluate it.

To withdraw, the consumer must notify the entrepreneur in writing/email within 30 days and return the product within 30 days after notification. Proof of return is required.

If not notified or returned within deadlines, the purchase becomes final.

Article 7 – Costs in Case of Withdrawal

Return shipping costs are borne by the consumer.

If payment was made, it will be refunded within 30 days after cancellation, provided the product has been received or proof of return is shown.

Article 8 – Exclusion of Withdrawal

Withdrawal may be excluded for products:

custom-made to consumer specifications;

clearly personal;

not returnable by nature;

perishable;

price-dependent on financial markets;

newspapers/magazines;

unsealed audio/video/software;

opened hygiene products.

Withdrawal may also be excluded for certain services (e.g., dated events, started services with consent, gambling).

Article 9 – The Price

Prices remain unchanged during validity except for VAT changes.

Variable prices may apply for market-fluctuating goods.

Price increases within 3 months are only allowed due to legal changes.

After 3 months, increases are allowed only under specific legal or contractual conditions.

Delivery location determines VAT rules; import VAT and customs fees are paid by the customer.

All prices are subject to typographical errors; the entrepreneur is not bound by incorrect pricing.

Article 10 – Conformity and Warranty

Products/services must comply with the agreement, specifications, quality standards, and legal requirements.

Warranty does not affect legal consumer rights.

Defects must be reported in writing within 30 days of delivery. Returns must be in original packaging and condition.

Warranty equals the manufacturer’s warranty period. It does not cover misuse, modifications, negligence, or regulatory material issues.

Article 11 – Delivery and Execution

The entrepreneur will handle orders carefully.

Delivery is made to the provided address.

Orders are fulfilled within 30 days unless otherwise agreed.

If delayed or impossible, the consumer may cancel without cost and receive compensation/refund within 30 days.

Replacement items may be supplied when necessary; withdrawal rights still apply.

Risk remains with the entrepreneur until delivery.

Article 12 – Duration Transactions

Cancellation:

Consumers may terminate indefinite contracts anytime with max one-month notice. Fixed-term contracts may be canceled at term end with similar notice.

Extension:

Fixed-term contracts cannot be automatically renewed except under specific conditions (e.g., magazine subscriptions).

Duration:

Contracts longer than one year can be terminated after one year with up to one-month notice.

Article 13 – Payment

Unless otherwise agreed, payment is due within 7 working days after the cooling-off period begins.

Consumers must report payment data errors immediately.

In case of non-payment, reasonable costs may be charged.

Article 14 – Complaints Procedure

Complaints must be submitted clearly within 7 days after discovering defects.

They will be answered within 14 days. If more time is needed, an acknowledgment and timeframe will be provided.

Unresolved complaints may lead to dispute procedures.

Valid complaints may result in free repair or replacement.

Article 15 – Disputes

These agreements are governed exclusively by The US law, even if the consumer lives abroad.

Article 16 – CESOP

Due to regulations effective from 2024 related to payment service providers and the EU Central Electronic System of Payment Information (CESOP), payment data may be recorded in the CESOP system.
